Anti-discrimination

While the CEA strongly supports efforts to prevent discrimination, it wishes to ensure that any legislation does not inadvertently hinder legitimate risk assessment by insurers.

In accordance with the EU equality principle, insurers treat people in comparable situations equally and those in different situations differently – ie, they differentiate but do not discriminate. If this core principle of risk assessment is not maintained, premiums could increase, coverage could decrease and some insurance products could be withdrawn from the market entirely.

The CEA's work on anti-discrimination centres on the European Commission's (EC) draft anti-discrimination directive of July 2008 and its review of the Gender Directive, and on developments in the European Court of Justice on the Test-Achats case brought by the Belgian Constitutional Court for a preliminary ruling on whether the derogation in the Gender Directive allowing EU member states to permit insurers to differentiate on the basis of gender was compatible with the EU principle of equal treatment of men and women.
